WHAT IS AN INTERNATIONAL RE-ADOPTION?
The vast majority of international or foreign adoptions are finalized in the country of origin. When returning to the United States most new adoptive parents enter into the process of re-adoption within their state such as Illinois. As the United States recognizes these legal international adoptions already in many cases, these re-adoptions are often seen as a way for the courts to formally recognize foreign judgement.
Re-adoption is also used to obtain a legal document known as a “Record of Foreign Birth” which acts as a US birth certificate. This is advantageous because without this, the family or child would have to return to the country of foreign birth to re-attain a new birth certificate.
It is however important to remember that not all jurisdictions or states recognize foreign adoptions, but once a re-adoption occurs this is no longer an issue.
Illinois law states the following, "Any time after a minor child has been adopted in a foreign country and has immigrated to the United States, the adoptive parent or parents of the child may petition the court for a judgment of adoption to re-adopt the child and confirm the foreign adoption decree."
However, the adoptive parents have to show provide various forms of documentation to the court in order to comply with this statute.”
