AM I ALLOWED TO ADOPT AN ADULT IN ILLINOIS?

The Illinois Adoption statute states: "with respect to an adult, that such adult has resided in the home of the persons intending to adopt him at any time for more than 2 years continuously preceding the commencement of an adoption proceeding, or in the alternative that such persons are related to him within a degree set forth in the definition of a related child" in the Adoption Act. 750 ILCS 50/3.

WHEN IS ADULT ADOPTION THE RIGHT DECISION?

Adult adoption is more common than some might think. One of the most common reasons someone seeks to adopt an adult is a situation where the prospective parent (often a stepparent or relative) has filled the parental role for a period of time and they now want to be legally recognized as a parent.

 An adult adoption is also a way to possibly avoid a contested adoption. After the age of 18 the parties involved no longer are required to give notice of the adoption to the birth parent as the adult can consent to their own adoption.
